All buses:

  • are owned and equipped with a regular License for Rental from Remittance;
  • are subject to annual review by the competent MCTC Inspectorate;
  • are insured with a ceiling of €50,000,000.00 through a leading insurance company;
  • are duly equipped with a chronotachograph, with annual certification of the fact that they have been checked by an authorized workshop;

All drivers:

  • they are regularly hired and in sufficient numbers to ensure a suitable rotation for driving and rest times;
  • they are all in possession of a regular driving license and consequent KD/CQC Professional Enabling Certificate;
  • are subjected to periodic examinations by the Competent Doctor

All staff are required to scrupulously comply with the Highway Code (also with regard to driving and rest times) and the use of a 2nd driver is guaranteed if the journey exceeds 9 hours of driving per day.

PERSONNEL REQUIREMENTS AND REGULATORY DRIVING AND REST TIMES FOR DRIVERS (EU REG. 561/2006)

The buses are driven exclusively by Company drivers in respect of whom all social security, welfare and salary obligations envisaged for the category are fulfilled; the drivers are equipped with the legal qualifications and professional documentation.

Periodic training is also provided. In the use of traveling personnel, the Company applies the national and European legislation in force regarding the regulation of driving times and daily rest periods for drivers engaged in non-scheduled services; in particular, the following is expected within the 24-hour period:

  • – the total driving time must not normally exceed 9 hours per day
  • – continuous driving time must not normally exceed 4 and a half consecutive hours and must be followed by 45 minutes of rest.

Alternatively, two breaks are foreseen, without fail of at least 15 + 30 minutes, within the 4 hours and 30 minutes of driving and the second break must necessarily be of at least 30 minutes, even if the first lasted more than 15 minutes;

  • – the driver must normally take 11 consecutive hours of rest.

(in practice, a service with effective departure at 7.00 in the morning, must provide for a return by 20.00. Otherwise, a second driver must be used, with the charge foreseen in the "surcharges" point).

There are only two exceptions to 9 hours of rest, provided that the conditions exist, based on the working hours worked in the previous days and weeks.

SEATS IN THE BUS AND LUGGAGE

On buses, passengers are required to always wear seat belts if they occupy a seat equipped with seat belts.

Furthermore, when the bus is in motion, all passengers are required to remain seated.

The company is not required to answer for any injuries due to accidental falls, damages and penalties deriving from failure to comply with the aforementioned rules, which will be charged to the transgressor if an adult, or to the manager of the group if a minor.

It is forbidden to bring luggage on board the bus that impedes the access and passage ways.

Backpacks or small bags are allowed, provided they can be accommodated in the overhead lockers. Luggage will generally have to find accommodation in the luggage compartment of the coach.

VEHICLE REQUIREMENTS

All the buses used are duly registered with a suitable title, and in compliance with the provisions in force regarding the annual review by the Provincial Office of the M.C.T.C. competence.

The company organization provides for the management of punctual ordinary and extraordinary preventive control/maintenance interventions, on a scheduled basis, in order to guarantee the constant maintenance of the efficiency and safety conditions of the vehicles.

Before each service, the vehicles are subjected to specific internal and external cleaning.

The coaches used for "rental" services have the following minimum standard equipment: air conditioning, satellite navigator, reclining seats, mini-bar, CD player, hi-fi radio.

The availability of vehicles equipped with automatic electro-hydraulic lifting platforms is also envisaged, equipped for the transport of non-ambulatory disabled users (in wheelchairs).

TRAVEL PROGRAM

The service is carried out according to the travel program agreed by the Customer with the Company.

Changes to the service (defined in the confirmation), must be communicated to the Rental Office at least three days before the date of execution of the same.

Any changes that may become necessary during the service/journey must be defined with the driver: the same will take steps to note them in the appropriate space provided on the "service order" and must be compulsorily countersigned by the Customer, or by the person in charge of the group, for acknowledgment and confirmation.

The driver is required to make the changes requested by the Customer or by the head of the group compatibly with the regulations in force which regulate the driving hours and the maximum duration of the service, and with the possibility of using the vehicles compatibly with the routes; the assessment relating to the use of the vehicles on route variations is the exclusive responsibility of the driver.

If the changes agreed upon after the start of the service produce a greater mileage than that envisaged in the estimate phase, they will result in the adjustment of the agreed price, unless otherwise agreed upon with the Rental Office before departure.

FORCED SERVICE INTERRUPTION

The interruption of the service due to force majeure does not entail the right to a refund.

In the event of a technical breakdown of the vehicle, the Company guarantees timely intervention in order to limit the inconvenience of travelers as much as possible through the activation of its structure or of the affiliated organizations for vehicle repair or replacement interventions.

RESPONSIBILITY

All buses are insured for risks deriving from road traffic in accordance with law 990/69.

Specific policies stipulated with leading insurance companies guarantee coverage with adequate ceilings in favor of the passengers.

LOST ITEMS

At the end of the service, the party manager is required to check for the presence of objects forgotten on board, relieving Lariobus Srl from subsequent disputes or recourse of any kind.

In the absence of such verification, the Company is not liable for lost or not found items.

DAMAGES CAUSED BY TRAVELERS

Any damage caused by travelers to the bus, to parts of the same, accessories, and components, will be charged to the person directly responsible or to the purchaser of the trip.

RULES PROVIDED FOR IN THE CONDITIONS OF TRANSPORT

For anything not provided for in these "travel rules", reference must be made to the law relating to rental contracts.

LEGAL DISPUTES

In the event of a dispute, the Court of LECCO (LC) is to be considered competent.
